The below prerequisites apply to all content I create for a brand (‘your’) make.
CONTENT AND MATERIALS
With ‘content’ I mean very simply everything I make. Everything you see on my rate card and everything else I make for you. Each creation is a separate piece of ‘content’. To avoid confusion between my content and yours, I call everything you provide me with ‘materials’. Whether it is a reference, a hashtag, an image or something else.
RECOGNISABLE ADVERTISING
Content I create is often advertising and that means it should also be recognisable as advertising. I think it is very important to be transparent about this and it is also required by law (thegreenlist.nl is also affiliated with DDMA as a certified influencer). Would you like to collaborate with me? That means you agree to me posting or incorporating the following mentions in my content:
- In my magazine (site), I always put a standard line at the top of the article (under the second headline): In collaboration with...
- on my Instagram page @THEGREENLIST.NL:
- Do I place a business tag in the post/in a story. You will then see at the top of the post ‘Paid partnership with...’ or a post ends with #AD or #advertising.
- Place I always #geted at a charter cooperation.
- I often also tell people in the caption of the post that it is a collaboration.
PERFORMANCE AND RESULT
- It is your responsibility to give me clear instructions on the actual content. You can expect me to make every effort to execute our agreement as carefully as possible. However, I always retain complete freedom to create the content at my own discretion.
- The agreed rate always includes one round of correction on the actual content of my content. This is in the scripting phase. So that's your chance to iron out any mistakes in messaging or product information. Within the pricing set, there is room for one photo and/or video shoot. A re-shoot or re-edit is not included in the project price.
- For additional feedback, extra rounds of corrections or special requests that involve extra work or costs, we will charge extra on an after-the-fact basis (see rate card for hourly rate).
- Corrections in the creation itself - basically anything to do with flavour or style, or which on reflection still need to be added or changed - are not included in the rate and are charged via an hourly rate (see rate card). Not satisfied with the chosen way of promoting your product and want me to record a new video? Typical example of a correction in creation.
- My content does not guarantee any (sales) result in any form.
- All fees are in €, excluding VAT, travel time (€70 p.h.) and kilometre allowance (€0.30 per km), parking and other expenses (including one round of corrections).
- Quotations and offers are valid for 30 days from the date they are issued.
PAYMENT
The payment term for my invoices is 30 days. After that, you are immediately in default, without notice of default being required. From then on, you owe not only statutory interest, but also full compensation for extrajudicial collection costs, and always with a minimum amount of €250.
SIGN UP
Once we have agreed verbally or in writing that I will create content for you, we have an agreement. Now, I also understand that content is very personal. If we don't have the right click in that, it is nice to be able to cancel. For this, we agree on the following:
- Is it about one-off content or a content series/campaign with a duration we agree on beforehand? Then neither of us can cancel and we just have to honour our agreements in full.
- Is it an ongoing partnership (a retainer)? In that case, we are both allowed to terminate mid-term by the end of the month and with one month's notice.
- Is either of us under suspension of payments, bankruptcy, WSNP or applying for it? We can both terminate with immediate effect without owing anything further to each other.
- Cancellations we both always do in writing.
INTELLECTUAL PROPERTY
- All intellectual property rights to the content I create, including copyright, belong to me and remain with me. For example, copyright on the content of my magazine and my videos and photos. My content may not be used or shared for any purpose other than that for which I created it. Do you still want this? Then of course we can make additional agreements about this, to which I can also impose additional conditions.
- Social media is a different story. Content consisting of posts, stories or videos in which I have tagged you on Instagram can of course be shared, provided you tag me in them. Re-posting is again only allowed with my prior permission, so only if we have agreed on that.
- Do you want me to incorporate materials from you into my content? No problem! Just know that by supplying materials to me, you guarantee that you have full free use of those materials and that those materials do not infringe any third-party rights. You indemnify me against any claims, demands or damages from third parties related to your materials.
LIABILITY
You are entirely responsible for the content of my content. Not for nothing do we have a round of corrections on their content. My content does not guarantee results and the use of my content is at your own expense and risk. You can only hold me liable for any damage caused by or because of my content if I have acted with intent or gross negligence in doing so. All further liability is excluded.
STATISTICS
A one-off review of content results is included in the fee. I share print screens with you via a Google link. When I create different content for a campaign, you will receive the results at the end of the full campaign. I make the results available for a month, after which I will delete the print screens from my cloud. Forgot to watch or download? For an additional fee of €45 (ex VAT), you will receive the results again. This is because I then have to collect all the data again. Additional administration fees may also apply if specific tooling needs to be used for content tuning and/or sharing results.
OTHER CONDITIONS AND INFORMATION
WINACTIES
In addition to content, we can also agree to organise win promotions together. For all win actions same match sequence. Transparency for participants is paramount in this. Therefore, these conditions always apply and cannot be adjusted for individual winning actions.
PRIVACY
When I process personal data in our cooperation, I always do so in accordance with my privacy statement.

By ‘content’ I simply mean everything I create. Everything you see on my rate card and all the other things I make for you. Each creation is a separate piece of ‘content‘. To avoid confusion between my content and yours, I refer to everything you provide to me as ‘materials’. Whether it is a reference, a hashtag, an image or something else.
RECOGNISED ADVERTISING
Content that I create is often advertising, which means that it must also be recognisable as advertising. I value transparancy next to the legal requirements about this (thegreenlist.nl is also affiliated with DDMA as a certified influencer). Do you want to cooperate with me? This means that you consent to me placing or processing the following statements in my content:
- In my magazine (website), I always include a standard line at the top of the article (under the second heading): “In collaboration with...”
- On my Instagram page @THEGREENLIST.NL:
- I include a business tag in the post or story. This will display ‘Paid partnership with...’ at the top of the post, or the post will end with #AD or #advertising
- I always add #gekregen (gifted) for barter collaborations.
- I often mention in the post caption that it involves a collaboration.
IMPLEMENTATION AND RESULT
- It is your responsibility to provide me with clear instruction. It is also your responsibility that the information given in my content is factual and correct. You can expect me to make every effort to execute our agreement as carefully as possible. I always retain complete freedom to create the content according to my own judgment and insight.
- The agreed-upon rate always includes one round of revisions for the factual content of my material. This takes place during the script phase, giving you the opportunity to correct any errors in messaging or product information. The pricing also covers one photo and/or video shoot. However, a re-shoot or re-edit is not included in the project fee.
- For additional feedback, extra rounds of revisions, or special requests that involve extra work or costs, we will charge additional fees based on post-calculation (see rate sheet).
- Corrections in the creation itself - basically everything that has to do with taste or style or changes/additions requested upon further reflection - are not included in the rate and are charged via an hourly rate (see rate sheet). Not happy with the chosen way to promote your product and want me to record a new video? Typical example of a correction in the creation.
- My content does not guarantee any (sales) result in any form whatsoever.
- All rates are in €, excluding VAT, travel time (€ 70 p.u.) and mileage reimbursement (€ 0.30 per km), parking fees, and other expenses (including one round of revisions).
- Quotations and offers are valid for 30 days from the date they are issued.

Once we have agreed verbally or in writing that I will create content for you, then we have an agreement. Now I also understand that content is very personal. If we don't have the right click, it's nice to be able to cancel. We agree on the following for this:
- Is it a one-time piece of content or a content series/ campaign with a predetermined duration? In that case, neither of us can cancel, and we must fully adhere to our agreements.
- Is it an ongoing collaboration (a retainer)? In that case, either party may cancel at the end of the month with a one-month notice period.
- Does one of us have a suspension of payments, bankruptcy, WSNP or an application to that effect? We can both cancel with immediate effect without owing each other anything further.
- Only a written cancelation is valid (via e-mail).
INTELLECTUAL PROPERTY
- All intellectual property rights in the content I create, including copyright, belong to me and remain with me. For example, the copyright on the content of my magazine my videos and photos. My content may not be used or shared for any purpose other than what I created it for. Do you want this? Then we can of course make additional agreements about this, whereby I can also set additional conditions.
- Social media is a different story. You can of course share my content that consists of posts, stories or videos in which I have tagged you on Instagram, provided you tag me in it. Re-posting is only allowed with my prior permission, so only if we have agreed.
- Do you want me to incorporate materials from you into my content? No problem! Please note that by supplying materials you guarantee me that you have complete free disposal of those materials and that those materials do not infringe any rights of third parties. You indemnify me against any and all third-party claims, claims, or damages related to your materials.

You are fully responsible for the information given in my content, that's why we incorporated a correction round. My content does not guarantee results and the use of my content is at your own expense and risk. You can only hold me liable for any damage caused by or because of my content if I acted with intent or gross negligence. All further liability is excluded.
STATISTICS
A one-time overview of the results of the content is included in the rate. I'll share screenshots with you through a Google link. When I create different content for a campaign, you'll receive the results at the end of the campaign. I make the results available for one month, after which I'll remove the screenshots from my cloud. Forgot to check or download? For an additional fee of € 45 (excluding VAT), you can receive the results again. This is because I need to gather all the data once more. Additional administrative costs may also apply if specific tools are needed for coordinating content and/or sharing results.
OTHER TERMS AND INFORMATION
GIVEAWAYS
In addition to content, we can also agree that we organise giveaways together. The same contest process applies to all giveaways. Transparency for the participants is paramount. Therefore, these terms always apply and cannot be modified for individual giveaways.
PRIVACY
If I process personal data in our collaboration, I always do so in accordance with my PRIVACY STATEMENT.
